E-cigarettes have existed for about 30 years, but they didn’t get major attention until the early 2000s when Chinese-manufactured e-cigarettes hit the U.S. market. Since then, they’ve greatly increased in popularity, and now the tobacco companies are trying to get a piece of the action.

The tobacco industry, which once upon a time legally and proudly sold its products to millions of Americans, has undergone a lot of changes, many of them forced on it by law. Required warning labels, restrictions on advertising and lawsuits have forced Big Tobacco to more or less discourage people from buying its own products. When e-cigarettes came along, Big Tobacco undoubtedly saw them as a further threat to its existence. But a few years ago, the tobacco companies decided that e-cigarettes could hold the key to their future, if they could get in on the e-cigarette market too.

Lorillard bought out the popular e-cigarette brand Blu, but then RJ Reynolds took over Lorillard, and Blu was sold to a tobacco company in Europe. RJ Reynolds then launched its own e-cigarette, Vuse, which is now selling well in the United States.

British American Tobacco also has the Vype, and the MarkTen is a product of Altria, formerly Philip Morris. There’s also iQOS, a hybrid e-cigarette that’s being test marketed in Japan and other parts of the world.

While tobacco companies still represent only a small portion of the e-cigarettes on the market, they are clearly becoming more interested in getting into the vaping game. And with the money tobacco companies have compared to the many smaller companies that manufacture all the other e-cigarettes and personal vaporizers, it is likely that Big Tobacco will be able to corner the market on vaping soon.
The problem this presents is not only that it could wipe out smaller e-cigarette manufacturers, but that sometimes those e-cigarettes are better and quite possibly safer than what tobacco companies might create.

Take for example, the iQOS, which is not actually an e-cigarette but a hybrid cross between an e-cigarette and a real cigarette. It involves what Philip Morris calls a “tobacco stick” that is heated, rather than burned, to produce vapor. As far as health is concerned, this seems to be a step backward from e-cigarettes that contain no tobacco, yet Philip Morris parent company Altria is bound to use its financial resources to promote the iQOS to the top of the e-cigarette market. Tobacco companies can also afford the expensive testing process that the FDA now requires to allow vaping products to be sold, which means that in the near future, most all e-cigarettes available might be part of Big Tobacco.

The other problem with this is that nobody trusts Big Tobacco, and the reputation of e-cigarettes will suffer when they are linked to the tobacco companies. In the minds of many people, they already are. Some anti-smoking advocates have made misleading statements that talk of the e-cigarette industry and the tobacco industry as if they are one and the same. For years, this has definitely not been the case, but now that tobacco companies are entering the e-cigarette market, vaping will become even more suspect of not being any better than smoking.

There is much genuine science showing evidence that e-cigarettes are nearly 100 percent safer than tobacco cigarettes, but now tobacco companies are funding e-cigarettes research, which will give opponents reason to be suspicious. Certain entities, from pharmaceutical companies to governments trying to make up for lost cigarette tax dollars, may be sponsoring biased research of their own and looking for excuses to say that e-cigarettes are a bad thing. But when the public is presented with conflicting evidence, some sponsored by the pharmaceutical industry or the FDA and the other sponsored by Big Tobacco, who are people going to believe?

The battle against false statements and health scares about e-cigarettes is an uphill one, because it depends on people understanding the facts behind the headlines and the official government statements. Having the tobacco industry as a partner in the vaping community could make even more smokers quit cigarettes and switch to vaping, but it could also permanently marry cigarettes and e-cigarettes in the minds of everyone and spell doom for vaping completely.

A bill that never made it very far last year has been reintroduced in the House of Representatives with the hope that it can save smokers from losing one of the safest alternatives to cigarettes. The Cole-Bishop Amendment would change the Food and Drug Administration’s deeming rules; rules that could wipe most e-cigarettes and e-liquid off the market if they stand as they are.

The problem e-cigarette proponents have with the FDA rules is not the requirements for labeling and warnings, nor is it the requirement that only people over 18 years of age be able to purchase vaping products. Contrary to what anti-vaping groups claim, pro-vaping groups have always believed in age-restriction and full disclosure about ingredients in their products. The issue at hand is the grandfather rule that exempts only vaping products made prior to 2007 from the rules. The 2007 date means that most products currently on the market will be subject to the rules, and that could spell big trouble because of one issue: money.

The most difficult part of the rules that e-cigarette and e-liquid manufacturers will have to comply with is the required testing to get FDA approval. This is an expensive process, and even though studies have shown time and again that e-liquid is far safer than tobacco smoking, getting the FDA to officially declare any e-liquid as safe enough to be sold will require a manufacturer to fork over possibly a million dollars per liquid they manufacturer. Since most e-liquid and e-cigarettes are manufactured by small companies, most of them simply will not be able to afford the cost.

The bill, which is a joint effort between Democrat Sanford Bishop of Georgia and Republican Tom Cole of Oklahoma, would change the grandfather clause to allow all current vaping products to be exempted. Last year, budget issues delayed action being taken on the bill, but it was reintroduced on February 16. It is officially called the FDA Deeming Authority Clarification Act of 2017, as it seeks clarification on the grandfather date and aims to move it to 2016 so the rules will only apply to new products going forward.

Representative Cole acknowledged that there is disagreement about whether certain tobacco products should be subject to regulations at all, but said that there should be agreement that the deeming rules should not apply retroactively to products because that is “inconsistent” and unfair. Cole’s office also commented that the current FDA rules make it harder for e-cigarettes to come to the market than tobacco cigarettes.

Representative Bishop offered words of praise for vaping in general, saying that vaping products offer, “A promising path for harm reduction for those seeking to quit or limit their smoking.”

A community in Wisconsin is getting help from local officials to fight unfair FDA rules that could wipe e-cigarette retailers out of business. Johnson Creek Enterprises, a major e-liquid retailer, was informed by its local village board that the board will help them challenge the FDA.

The FDA decided in August 2016 that all e-cigarette products manufactured after 2007 will need to have official approval in order to be sold. The rules cover tobacco products, which e-cigarettes are considered to be because of a separate FDA decision. The rules also require warning labels and forbid sales to people under the age of 18.

Johnson Creek has no problem with the age-restriction and warning labels, in fact, like most e-cigarette product retailers, they have always voluntarily implemented these things before they were required. The problem is that the approval requirement for products manufactured after 2007 involves most e-cigarette and vaping products on the market, and most e-cigarette businesses are small and not able to afford the price tag associated with getting FDA approval.

The cost of getting FDA approval is mostly in testing. It’s expensive; the president of Johnson Creek, Heidi Braun, estimates that it would cost about $1 million for each product her company would need to submit for approval.

The FDA’s “2007” rule is one of its most unfair and illogical rulings on e-cigarettes to date, because it could hurt small businesses while at the same time actually help tobacco companies. The major tobacco companies are putting vaping products on the market, and they are the only vaping manufacturers with the financial ability to get the approval the FDA is demanding.

The village board of Hartland, WI agreed to back Johnson Creek Enterprises in its fight. Local governments do have the option of intervening when federal rules affect local businesses. Board trustee Rick Stevens is an e-cigarette user who quit smoking by switching to e-cigarettes. He used the step-down method by starting with nicotine e-cigarettes then gradually reducing the amount of nicotine until he was able to vape no-nicotine e-liquid. He says he doesn’t understand “the big problem” with e-cigarettes, seeming to refer to the heavy regulations and restrictions. The board voted unanimously to help Johnson Creek.

According to the Johnson Creek website, it was the first company in the U.S. to sell e-liquid. It has customers in more than 120 countries and sells to some large e-cigarette manufacturers, including Blu and Fin. In order to visit the Johnson Creek website, a visitor must enter their exact date of birth. If the date is less than 18 years ago, they will be booted to Google. Though this is not a foolproof method of keeping minors from purchasing, it is the type of voluntary restriction that most small e-cigarette businesses have been employing for years. In addition, Johnson Creek began restricting sales to people 21 and over in January. The site has a nicotine warning at the bottom of each page, lists ingredients on product labels and uses tamper-proof and child-resistant packaging on its products.

As e-cigarettes and vaping become more popular, the debate about their relative safety compared to smoking gets more heated. Despite having little valid evidence to support the contention that vaping is harmful, many anti-smoking groups have taken the position that e-cigarettes are a danger that should be avoided. Taxes and bans are everywhere in the United States, and headlines continually shout about studies that “prove” that e-cigarettes are dangerous, addictive, a threat to children and a gateway to smoking tobacco cigarettes.

A reality check shows that most of the studies done thus far on the effects of vaping show none of these things, and in some cases show the opposite. The numerous groups that want to scare people away from e-cigarettes spin data and misrepresent the facts. One major study from the United Kingdom that showed e-cigarettes to be approximately 95% less harmful than tobacco smoking was largely ignored by the U.S. media. But now, another British study is getting some attention on this side of the Atlantic, even though it once again shows that e-cigarettes are dramatically safer than regular cigarettes.

The study, conducted by Cancer Research UK and published February 6 in the Annals of Internal Medicine showed that people who quit smoking by using e-cigarettes decrease the toxins and carcinogens in their bodies as much as people who quit smoking by using nicotine replacement products like gums and patches.

Though the report on the study has been picked up by U.S. media, including CBS News and AOL, opponents of e-cigarettes have been quick to inject negatives into the conversation. The AOL report, along with a representative for the American Lung Association who was quoted by CBS, point out sharply that the study showed that quitting smoking 100 percent in favor of e-cigarettes would be necessary in order to have a dramatic reduction in toxins. However, a close look at the results of the study show that the same thing was found to be true with regards to nicotine gums, patches or lozenges.

In other words, someone who still smokes while using e-cigarettes or other nicotine replacement products is going to maintain a high level of toxins and cancer-causing chemicals in their bodies. Well of course they are; those toxins and carcinogens are still coming from the tobacco cigarettes they use. But opponents of vaping and e-cigs will use this one part of the study, as it pertains to e-cigarettes only, to warn that the study proves nothing about the benefits of e-cigarettes unless someone quits smoking cold turkey.

What the study truly shows is what has been shown in numerous studies before: e-cigarettes have no clear dangers and are delivering nicotine to people who are trying to quit smoking as effectively as other nicotine replacement products.

A Democratic state senator in Texas wants to raise the legal age for purchasing tobacco in the state to 21. Though this could be a good move to curb teen smoking, the legislation would, as is often the case, include e-cigarette and vapor products along with tobacco.

State Senator Carlos Uresti cited the cost of smoking-related health issues as a primary reason for his proposal to raise the tobacco-buying age to 21. In addition to smoking health problems costing taxpayers money, Uresti, a Marine, says that the Department of Defense forks over $1.6 billion a year because of tobacco use among enlisted members of the military.

But Uresti also wants to add e-cigarettes and vaping products to the bill, which would legally prevent adults between the ages of 18 and 21 from purchasing these products. Uresti says this is about younger teens, however, because he believes that peer pressure on teens aged 15 to 17 would be reduced by raising the vaping purchase age to 21.

Another Texas democrat, Donna Howard, has filed a companion bill in the State House of Representatives. While anti smoking and anti vaping laws are more often championed by Democrats, in Texas, at least one Republican, Rep. John Zerwas, has stated that he is behind the bill. Zerwas is a doctor who says that public health is his primary reason for support the bill.

The Texas Medical Association and the American Heart Association are in favor of raising the tobacco-buying age to 21. There appear to be few arguments against keeping tobacco out of the hands of younger adults, but a consumer freedom associate, Guy Bentley, pointed out that smoking rates are on the decline in Texas anyway, without this type of legislation. Bentley is against the proposed bill.

Including vapor products and e-cigarettes in the legislation has brought many arguments. Bentley says that legally banning adult teens and 20-year-olds from purchasing vaping products could harm those who already smoke tobacco cigarettes. British research has shown that vaping is not something that non-smokers are picking up as a habit. Most people who vape are in fact smokers trying to quit or former smokers who have successfully quit. Many smokers and former smokers are speaking out against the Texas bill.

Some opponents of the inclusion of vaping in the legislation say fear drives the government when it comes to e-cigarettes. The FDA, says Michelle Minton of the Competitive Enterprise Institute, worries about the possibility of future harm from e-cigarettes because it could be held responsible. The agency is usually held responsible for approved products that cause harm, but not for the failure to make products available that could have reduced harm. So he FDA is protecting itself by choosing to restrict e-cigarettes.

Bentley sums it up by saying that the Texas bill is a solution looking for a problem, because teenagers are not getting hooked on e-cigarettes and they are not even smoking cigarettes much these days. While he believes that tobacco and e-cigarettes should be prohibited for teens under 18, he doesn’t think an age increase is necessary. He also cites freedom of choice and civil liberties that would be violated if the age were raised to 21. “These proposals will say you are responsible enough to fight for your country overseas and risk your life,” he states,” but you are not responsible enough to choose whether you want to smoke a cigarette or use vapor products.” Bentley calls that a “fundamental infringement” on the civil liberties of adults.

Pennsylvania is one of several states that is waging a war on vaping at the government level, using taxes as a primary weapon. Vaping and e-cigarette supporters fought back by holding a rally in Harrisburg, the state’s capital, on January 23.

Pennsylvania started taxing wholesale e-liquid at 40 percent last October. This coincides with the state’s definition of liquid nicotine as a tobacco product. Though some e-liquid doesn’t even contain nicotine, and nicotine itself is not the same thing as tobacco, the “tobacco product” definition has gone a long way in Pennsylvania and other states in giving e-cigarette opponents the excuse they need to restrict vaping as severely as smoking is restricted.

For Pennsylvanians, there is some hope. Some politicians who understand the unfounded bias against vaping that the tax represents are working to eliminate or at least reduce it. Lawmakers who oppose the vaping tax have a plan to reduce it to only 5 cents per millimeter of liquid, and remove e-liquid from the state budget’s definition of tobacco products. State Senator Scott Wagner spoke at the rally, noting that the tax is meant to earn money for the state. He said that the tax was targeting a specific industry to pay up and fix Pennsylvania’s current budget deficit.

Meanwhile, some vape shops have been force to shut down due to the heavy tax. The rally was attended by many vape shop owners, some who closed their stores for the day to attend, as well as many former smokers who have successfully quit because of vaping. The fact that vaping is healthier than smoking was stressed throughout the rally. Lawmakers across the country and in Federal government have been slow to accept the mountains of evidence that show significantly less, if any, harm from vaping as compared to smoking. Instead, many anti-vaping taxes and restrictions have been backed by the slim evidence that vaping might expose people to cancer-causing chemicals or that teenagers might choose e-cigarettes and get hooked on nicotine.

The vaping industry has always voluntarily stated that vaping is intended only for adult smokers as a means of switching to a safer alternative, and not as a new hobby to try or for anyone under the age of 18. Opponents of vaping have often made unfounded statements that the vaping industry is targeting children; the same accusation that has been made against the tobacco industry for decades. It has been relatively easy for anti-smokers to lump e-cigarettes into the same category as tobacco cigarettes and convince people that a fight against one is automatically a fight against the other.

The Pennsylvania bill to reduce the vaping tax was introduced last fall, but it was never voted on. The Harrisburg rally was intended to show state officials that there is much support for the bill and action needs to be taken.

While the point in vaping or using e-cigarettes is to help smokers kick the tobacco cigarette habit, tobacco companies have taken steps to enter the competition’s territory by manufacturing e-cigarettes of their own. The federal government, meanwhile, has continued to make it harder to buy and sell e-cigarettes and e-liquid by its decision that vaping and smoking are basically the same thing. Despite all evidence to the contrary, the government considers e-cigarettes to be tobacco products and subject to the same regulations.

Donald Trump has vowed to cut down on federal regulations for businesses, so the vaping industry and its supporters are hoping they can persuade the Trump administration to halt regulations that will make it extremely difficult for e-cigarettes to be sold. The new rules, set to take effect soon, will require that manufacturers submit vaping products for government approval and put warning labels on their products and advertising. The manufacturers will have to foot the bill for this expensive testing and labeling, and since most e-cigarettes are made and sold by small businesses, most will not be able to afford it. The law will apply to all e-cigarettes manufactured after 2007, which basically means all e-cigarettes on the market now. The end result of the regulations, if they go forward as planned, could be that the U.S. e-cigarette industry would be virtually wiped out.

A coalition of 13 organizations is asking Congress to change the rules to allow products made prior to 2016 to be grandfathered in. Eventually, they would like to get the rule that counts e-cigarettes as tobacco products lifted as well.

Meanwhile, the tobacco industry is becoming a player in the e-cigarette world as both Philip Morris and RJ Reynolds have introduced vaping products, though Philip Morris thus far has only put theirs on the market outside of the U.S. British American Tobacco and RJ Reynolds are merging to compete with Philip Morris, with the Reynolds Vuse e-cigarette already doing well in sales in the U.S. The Philip Morris device, called iQOS, is not a traditional e-cig but a device that heats tobacco in stick form to produce vapor.

If the 2007 rule is not changed, tobacco companies would be the e-cigarette manufacturers most likely to be able to afford the approval process and get their vaping products on the market. But tobacco companies are on board with the plan to get Congress to reduce vape product regulations, and these companies have a good deal of lobbying power.

Many health organizations, particularly those associated with government, are opposed to any reduction of vaping regulations because of their continued obsession with the possibility of children being seduced by nicotine. The hope for vaping is that the Trump Administration may be able to facilitate a government shift to a harm-reduction approach and away from the abstinence-only approach of the past several years.

Anyone who has been paying close attention to the science behind the claims that e-cigarettes are dangerous knows that the full findings of studies are being misinterpreted and sometimes downright discarded, while any odd result that shows some potential for harm from e-cigarettes is being quickly published and touted as absolute proof that e-cigarettes are dangerous. The studies behind all these e-cigarette bans and danger warnings have generally shown overall that there is no evidence of real harm from e-cigarettes and that they are definitely much less harmful than tobacco smoking, but the U.S. government has chosen to pretend the opposite is true.

The Surgeon General’s report released in late 2016 claimed that e-cigarettes encourage young users to take up smoking. A close look at the report by experts points to the opposite conclusion, which is more often becoming the standard result when e-cigarette studies are performed and reported on. U.S. government agencies interpret e-cigarette studies in the most negative way possible without flat out lying, while scientists and health officials see the reality, which time and time again shows no evidence of real harm from e-cigarettes, less harm from e-cigarettes than from tobacco cigarettes and no evidence of the “gateway effect” of e-cigarettes leading people to tobacco cigarettes.

The situation is clearly that the government wants to discourage people from using e-cigarettes, and is doing this by taxes and restrictions. The reasons for this are unknown, but may include money, politics, or knee-jerk reactions to e-cigarettes because they look like cigarettes. The FDA and now the Surgeon General have joined The American Lung Association and others in lining up against e-cigarettes. The problem, in part, is that there may be a domino effect: Where one agency goes, others follow. The National Parks Service apparently believes the Surgeon General and the FDA, and therefore only skimmed the surface for “evidence” that e-cigarettes are harmful before deciding to ban them along with smoking.

The NPS is taking public comments on the proposed e-cigarette ban until March 7, 2017. This is an opportunity for health experts and regular smokers alike to make their voices heard. Though there have been many studies conducted that demonstrate that e-cigarettes are less harmful – as much as 95 percent less harmful – than tobacco cigarettes, much of the evidence that e-cigarettes actually help smokers quit smoking is anecdotal. In addition, the anti-e-cigarette lobby has armed itself with the phantom “gateway effect,” which is difficult to either prove or disprove, and it is actively using this weapon in its efforts to make it difficult for people to obtain and use e-cigarettes.

People who use e-cigarettes and especially those who have successfully quit smoking because of them should contact the NPS with their comments on the proposed e-cigarette ban. Public comments about the success of e-cigarettes in helping smokers quit; demonstrations of common e-cigarette advertising campaigns, which are accused of targeting children but in reality are clearly aimed only at adults who already smoke; testimonials that demonstrate that using e-cigarettes tends to cause an avoidance of tobacco smoking and not the opposite, and presentation of sound scientific data could encourage the National Parks Service to reconsider its ban. If that were to happen, it could be an important event, as it would contradict the recent trend in official e-cigarette discouragement.

On January 2, 2017 it became more expensive for retailers in California to sell e-cigarettes or vaping hardware. Thanks to state legislation that puts e-cigarettes in the same category as tobacco, vendors must pay a license fee of $265 per year to be allowed to sell e-cigarettes in the state. In addition, California stores that sell e-cigarettes cannot be opened within 500 feet of a school or playground.

As firm believers that e-cigarettes are a danger to youth, many opponents of e-cigarettes are applauding the new laws. The Director of California’s Department of Public Health, Karen Smith, remarked, “The surge in e-cigarette use among teens and young adults is no accident. The tobacco industry’s aggressive marketing of e-cigarette gadgets and candy flavors is jeopardizing the health of our young people.”

That’s a curious statement, because the tobacco industry has virtually nothing to do with the manufacture or sale of e-cigarettes, and nearly all e-cigarette advertising features images of adults and language stating that e-cigarettes are intended only for smokers as an alternative.

As for the “surge in e-cigarette use among teens and young adults,” this has accompanied a drop in the rate of cigarette smoking in the same age group. Nevertheless, officials seem determined to keep young people from using nicotine at all, even if that means taking away an alternative to smoking that has been shown to be almost 100 percent safer. Complete abstinence from nicotine – and any habit that even resembles smoking – apparently, appears to be the only solution lawmakers will accept.

Medical science has known for quite some time that the real danger of nicotine is in the delivery system that cigarettes provide. While nicotine is technically a toxic chemical, dangerous toxicity is a matter of dosage. That’s why we can safely drink water that has a trace amount of arsenic in it, or drink alcohol. Nicotine is addictive, and that is the the primary danger it carries. Smoking is deadly, so addiction to the nicotine in cigarettes tends to keep smokers smoking, negatively affecting their health and quality of life and quite possibly shortening their lives.

But anti-smokers, and now, anti-vapers, always point to the toxicity of nicotine when arguing in favor of complete abstinence or “step-down” methods like nicotine gums and patches. California officials claim that researchers have found 10 chemicals in the liquid nicotine that is used in e-cigarettes that cause cancer, birth defects and reproductive harm. Traditional cigarettes are known to contain 400 or more toxic chemicals. Even if there are 10 dangerous chemicals in liquid nicotine (which has never actually been proven with sound scientific research), does it make sense to consider e-cigarettes to be the same as smoking?

Most health officials and logical-minded people say no, but lawmakers across the United States and in many other countries continue to promote e-cigarettes as a horrifying unknown threat that is probably going to kill us all. There is more concern about “second-hand vapor” possibly harming someone that there is about human beings we know are being harmed by smoking. The truth is that there is far more evidence that smokers are becoming healthier by switching to e-cigarettes than there is evidence that e-cigarettes are harmful, but until lawmakers understand this, it could be become increasingly more difficult for smokers to make the safer choice.

The highly anticipated Cole-Bishop Amendment has failed to clear the Senate floor, but that doesn’t mean it’s dead in the water just yet.

The Cole-Bishop Amendment, which you can read in-depth about on Moon Mountain, was put on hold temporarily. CSP Daily News is reporting that the amendment, which was created to ease the overreaching FDA regulations in the vaping industry, failed to get into the federal legislation budget that was passed last month.

For readers who may not be aware, the Cole-Bishop Amendment was created by U.S. Representatives Tom Cole, R-OK, and Sanford Bishop, D-GA, would have changed the FDA’s predicate date from February 15, 2007, to a date set in 2016. This would have given the vaping industry, which began flourishing in 2009, a reprieve from the onerous deeming regulations that set the price tag of PMTAs at over $500,000 per product.

It was not to be.

Gregory Conley, the president of the American Vaping Association, revealed that the proposed amendment did not make it into the legislation budget, which will fund the federal government up until April 25, 2017. President Obama has already signed the bill, meaning that no further changes to the legislation will be accepted.

However, the amendment is not dead yet. Representatives Cole and Bishop can still reintroduce the piece of legislation when the budget is again considered in the next session.

Many in the vaping industry are pulling for the amendment. There is real hope that it will be accepted next year, as it is sponsored and supported by legislators in both the House and the Senate and has the encouragement from both sides of the aisle.

The vaping industry has been under increasing pressure since the FDA regulations went into effect earlier this year. Dozens of businesses have already closed, and more are expected to do so by the beginning of spring. This has led to the unintended consequence of loss of revenue and small business jobs all over the country.

The need to fix the predicate date is an important issue. It is an arbitrary date that was assigned to vaping products, even though the industry, again, was not established until late 2008 and early 2009. That means all of the products on the shelves are currently in danger of being removed from the market.

This is cause for concern for any vaper, especially considering that the industry is seen as a safer alternative to smoking traditional cigarettes. To get rid of it altogether, which is what the predicate date might just do, would be a loss to the public health of America. This is why the Cole-Bishop Amendment is important, and this is why this publication will continue to update readers on the status of this legislation.

Those among us who have wondered about e-cigarettes making smoking more attractive to consumers needn’t have worried; the opposite is true.

That’s right: e-cigarettes and the public relations movement to push them forward as a smoking cessation method has actually curtailed consumers from smoking. It’s a crazy but not unheard of marketing ploy: to use a far more healthy alternative to a more deadly habit in marketing to make people less interested in a dangerous habit.

According to PsychCentral, a new study that has been conducted by the Centre for Substance Abuse Research, known as CSUR in Scotland, that shows that fewer people are less interested in smoking now that e-cigarettes have been introduced into the market. The findings of this journal, should any e-cigarette user be compelled to read it, can be found in the journal entitled International Archives of Addiction Research and Medicine.

This study surveyed over 100 responses of non-smokers between the ages of 16 to 25 and showed that young adults clearly understand the difference between e-cigarettes and traditional cigarettes. The distinction was so clear that most young adults involved in the study dismissed e-cigarettes as traditional cigarettes; this confirms the idea that e-cigarettes are seen as a replacement, and not a complement, to traditional cigarettes.

In fact, e-cigarettes piqued the interest of most smokers and some interested consumers; the product itself was seen as a just a smoking cessation method that was meant to curtail a person’s interest in regular smoking and nothing more.

As Dr. Neil McKeganey, the director of CSUR, stated:

“These results cast doubt on claims of a link between the increased popularity of e-cigarettes, their ensuing visibility when used in public, and any resulting increase in the desire to smoke tobacco among young people.”

McKeganey also voiced his opinion on the idea the claims that e-cigarettes may seem like a fancy gateway to those who already smoke by stating that:

“While the study suggests more people now consider vaping to be a ‘normal’ activity, it also shows that there is no basis for regulating e-cigarettes based on a fear they are making smoking more attractive because this fear is clearly unfounded. Any restrictions on their use, for example in public places, should reflect the reality that people do not think smoking is any more socially acceptable just because more people are seen to be vaping.”

What does this mean for those who use e-cigarettes on a daily basis in this country? It means that e-cigarettes are being used for the purpose intended: to curtail the use of traditional cigarettes in favor of products that are less harmful to not only consumers but their loved ones.

As tobacco giant Philip Morris is just a few steps away from launching its first e-cigarette product in the United States, evidence appears to support the theory that the Federal Drug Administration is doing all it can to help big tobacco crush the e-cigarette competition.

The Philip Morris product is called iQOS. It has been tested in international markets but the company has only recently requested FDA approval for U.S. sales. Approval is necessary due to the FDA’s deeming rules, which consider e-cigarettes to be tobacco products even though they do not contain tobacco. Furthermore, the iQOS differs from other e-cigarettes because it actually does contain tobacco.

The FDA deeming rules actually help tobacco companies by making it harder for e-cigarette manufacturers to get their products on the market. Proponents of e-cigarettes as a safer alternative to smoking point to the illogic of deeming e-cigarettes tobacco products and suggest the FDA’s deeming rule was actually designed to protect tobacco companies from competition.

But now the iQOS enters the mix with its hybrid design that makes it closer to a tobacco cigarette than any other e-cigarette or vaping product currently on the market. The iQOS works by heating sticks that look like cigarettes to produce vapor. The sticks contain tobacco, but like e-cigarettes, the device creates only vapor, not smoke. Philip-Morris touts the iQOS as tasting much more like real cigarettes than e-cigarettes without the chemical taste that e-cigarette liquid is said to have.

The iQOS has shot to the top of the e-cigarette market in Japan and was recently released in Great Britain. In addition to applying for approval for U.S. marketing, Philip Morris also wants the FDA to allow it to claim that the iQOS is safer than smoking. This will be an expensive process, as literally millions of pages of scientific statements will be submitted to the FDA.

If Philip Morris is awarded the right to claim that their iQOS is safer than cigarettes, that will put the iQOS in a position to completely dominate the e-cigarette market. Nearly all other e-cigarettes are produced by small companies that cannot afford to comply with the FDA regulations. The FDA rules allow the tobacco giants like Philip Morris to basically buy the “safer than smoking” label – and this despite the fact that iQOS is actually a tobacco product and other e-cigarettes are not, and some of them don’t even contain nicotine.

The iQOS is not completely unique. British American Tobacco, maker of Kent cigarettes, is producing devices similar to the iQOS. RJ Reynolds marketed a device of the same type back in the 1980s, but its sales were dismal and it was quickly discontinued. As of now, RJ Reynolds’ only entry into the vaping market is the Vuse, a normal e-cigarette that uses liquid.

For its part, Philip Morris does seem to be genuinely trying to get out of the cigarette market and give its customers a safer alternative. The problem for smokers is that big money could wind up telling them that a device that heats tobacco sticks is safer than any device that uses liquid, and that might not be the reality at all.

While reduction of nicotine intake and eventual overcoming of a nicotine addiction is the goal for most smokers who desire to quit, it is important than any method used to quit smoking deliver nicotine as well as cigarettes, with a “step down” method used to gradually wean off the drug. If an alternative to smoking fails to deliver nicotine effectively in the beginning stages of its use, the smoker is likely to give it up and return to smoking.

That scenario is more likely to happen with a smoker who does not know how to correctly use an e-cigarette, according to a study recently published in the American Journal of Health Behavior. Research performed by British American Tobacco in collaboration with Los Angeles Clinical Trials studied blood nicotine levels in participants who used e-cigarettes and tobacco cigarettes. Both older and newer models of e-cigarettes were used, and the results showed that for experienced e-cigarette users, older style e-cigarettes did not deliver nicotine as effectively as newer models, but that newer models of e-cigarettes did deliver nicotine as well or better than tobacco cigarettes.In a second study that involved smokers who were not familiar with e-cigarette usage, nicotine was not delivered as effectively through the use of e-cigarettes as it was through tobacco cigarettes. However, the urge to smoke was reduced for the smokers after smoking e-cigarettes.

The results indicate that newer models of e-cigarettes deliver nicotine more effectively than older models, but perhaps more importantly, that there is a right and a wrong way to effectively use an e-cigarette. Experience can teach e-cigarette users to correctly use the device, which is best used by taking longer draws than is usual with regular cigarettes. During the study, the participants who were inexperienced with e-cigarettes were first instructed to take a puff at a time on a regular cigarette every 30 seconds. They were then instructed to smoke a cigarette freely. Free-smoking resulted in better delivery of nicotine than instructed smoking, and the same was true with e-cigarette use.

The conclusion that can be drawn from this is that a smoker who begins using e-cigarettes may be trying too hard to imitate smoking a cigarette, something that has come naturally to them for a long time. In time, using an e-cigarette becomes natural, and every individual will find their “vaping style,” which could result in a better experience and better nicotine delivery.

It is also important that e-cigarettes on the market today are better at nicotine delivery than older e-cigarettes were. The study used Nicolites, an older non-rechargeable e-cigarette, and a Vype vPro pen. The Vype is similar to many e-cigarettes that are currently on the market and the type of device often chosen by more experienced users. Smokers who seek a first e-cigarette often prefer a “cigalike” like a Nicolite. One problem may be that this type of e-cigarette does not deliver nicotine effectively, causing many users to decide that e-cigarettes have failed and return to smoking. Considering a pen-style or larger e-cigarette could help a smoker stay with e-cigarettes and successfully quit smoking.

Voters in California made their feelings about smoking clear this past Election Day by passing Prop 56, a new tax on cigarettes, by a huge margin. The state had an 87 cent tax per pack on cigarettes that had not been increased in years, so as an effort to curb smoking, the proposed $2.00 additional tax seemed long overdue to many. The new tax on cigarettes will be comparable to cigarette taxes in some other states. The measure also includes taxes on e-cigarettes and related supplies. It was a ballot measure that covered two separate things, with voters having no choice but to vote for both or none. Did voters really mean to tax e-cigarettes as well as tobacco cigarettes? It’s hard to say, but like it or not, Californians will now be paying more for e-cigarettes, despite there being no evidence that they are harmful and are in all likelihood significantly safer than tobacco.

Here is the problem for states: Smoking rates have declined, largely due to increasing cigarette taxes, which are said to be designed to accomplish this very goal: get people to quit smoking. But when people quit buying cigarettes, tax money decreases. Governments say they care about their citizens’ health and want them to quit smoking, but when cigarette tax money decreases, they need to replace it. Enter e-cigarettes. By pretending that there is no evidence that e-cigarettes are safer than smoking, and by turning a blind eye to the fact that e-cigarettes contain no tobacco whatsoever, governments can say that e-cigarettes are pretty much exactly the same as tobacco cigarettes and tax them accordingly.

Here is the problem for smokers: They want to quit and know that e-cigarettes are safer, because there is evidence, especially if one looks outside of the United States to places like Great Britain, where science has openly declared the safety of e-cigarettes and encouraged their government to recommend them. But now in the U.S., e-cigarettes are being taxed, as well as restricted or in some places outright banned. This means that smokers may wind up with no other alternatives but nicotine gums or patches, which may have failed them before, smoking cessation prescription medications that have dangerous side effects, or if all else fails – going back to smoking.

The new tax in California could actually make it more expensive to use e-cigarettes than to smoke cigarettes. Between this and the continuing fear-mongering by anti-smoking groups about the supposed dangers of e-cigarettes, many smokers may decide that continuing to smoke is the lesser of two evils. Smoking is deadly; we know this. We also know that e-cigarettes have in fact helped countless smokers to quit tobacco. Making it more difficult or more expensive to acquire e-cigarettes hurts smokers by actually encouraging them not to quit.

The issue that comes up repeatedly in the debate about e-cigarettes is children. The anti-e-cigarette argument is that e-cigarettes may appeal to kids, especially if we dare admit that they’re probably safer than smoking. No one in the e-cigarette industry wants to see children or teens take up an e-cigarette habit. Rather than promoting their products to youth as they are often accused of doing, e-cigarette retailers make it very clear that they will not sell their products to anyone under 18 or in some cases, 21. They have done this voluntarily since the early days of e-cigarette sales on the internet, without any laws requiring them to restrict sales to adults. The accusation that e-cigarette sellers and manufacturers are targeting young people is completely unfounded, as are claims of health hazards that no legitimate scientific evidence supports.

The e-cigarette industry favors common sense legislation that would keep e-cigarettes out of the hands of young people, while allowing adults who smoke to decide which products to use to help them quit a deadly habit. Government seems to have a keen interest in limiting smokers’ choices to products that are tied to pharmaceutical companies and the FDA.

When ballot initiatives like California’s Prop 56 piggyback one measure on another, voters are often unclear about what they are voting for. This could become a popular way for governments to tax or even ban e-cigarettes, and then be able to claim that since it was done by vote, the people actually wanted it. If the full truth about e-cigarettes and their safety as compared to smoking was widely known, it’s hard to believe that anyone would want to discourage smokers from switching to e-cigs, especially anyone who is genuinely interested in the people’s good health.

Two new studies underway at Ohio State University aim to find out if e-cigarettes are safer than smoking. But if some preliminary statements from those involved are any indication, it seems that the researchers may have already made up their minds about e-cigarettes and are looking for the studies to confirm their bias.

For the first of the two studies, the researchers are looking for 60 people, including smokers, non-smokers, e-cigarette users and smokeless tobacco users. The idea is to compare non-smokers’ health with the health of people who use “tobacco products,” which the researchers consider e-cigarettes to be. Specifically, they are looking for exposure to cancer-causing chemicals.

Peter Shields, M.D., the deputy director of OSU Comprehensive Cancer Center, says that “there is no hard scientific evidence” that e-cigarettes are better or worse than tobacco cigarettes. He warns that e-cigarettes are a tobacco product and they should not be assumed safe until more research has been done.

Dr. Shields does not explain how, since they contain absolutely no tobacco, e-cigarettes are tobacco products. But the Food and Drug Administration would support his statement, having declared e-cigarettes to be a tobacco product, apparently because they contain nicotine. There is no indication of the type of e-liquid to be used in the OSU study, for example, the percentage of nicotine or any other specific ingredients contained in it.

The studies are being funded by the FDA and the National Cancer Institute, two organizations that have not been particularly friendly to the e-cigarette community. These studies appear to be tainted with anti-e-cigarette bias from the outset, and it seems unlikely that they will find the “hard evidence” Dr. Shields insists is necessary before anyone can assume that e-cigarettes are not even worse than smoking.

The studies were announced on November 1, and were timed to take place near the date of the Great American Smokeout on November 17th. The Great American Smokeout is a day when smokers are encouraged to quit smoking even for one day. As many smokers are turning to e-cigarettes as an alternative, the FDA and NCI seem to be scrambling for evidence on e-cigarette safety. Perhaps they should look to the United Kingdom, where e-cigarettes have been deemed by medical experts to be nearly 100% safer than smoking, or to any of the other studies that have shown no “hard evidence” of any particular dangers of e-cigarette use.

Instead, American government institutions continue to spend money on their owns studies, headed by people like Dr. Shields whose statements reveal an existing bias. The e-cigarette community should be prepared for the results of the OSU studies by considering the source.

The World Health Organization recently held a conference in New Delhi with e-cigarettes as the main topic of discussion. A report by an unnamed Swiss author prompted the conference, which was held to discuss the safety of e-cigarettes and whether or not they should be allowed or banned.

Some facts:

WHO has acknowledged that e-cigarettes are in all likelihood significantly safer than smoking, and the author of the study that brought about the ban discussion called switching from smoking to vaping an achievement for public health.

WHO called the conference “public” and it was paid for by taxpayers, but anyone who supports e-cigarettes and vaping was not allow to attend.

So what is going on here? That’s the question that many in the vaping community were asking, and they responded to their ejection from the meeting by holding a conference of their own nearby. The conference organizers and members drafted The Delhi Declaration, which demands that WHO allow adult smokers to have equal access to e-cigarettes and vaping products.

The concerns expressed about e-cigarettes are the usual: We don’t want kids to start vaping and we don’t know enough about e-cigarettes yet. The vaping community once again had to try to overcome these objections with some plain common sense. The issue of children and e-cigarettes should be dealt with by way of regulations, not complete bans. Complete bans leave adult smokers without access to a product that is known to be significantly safer than tobacco cigarettes. As for knowledge of the long-term safety of e-cigarettes, it is not usual for products to be withheld from the market until long-term safety testing can be accomplished. Or, as Tom Pinlac, president of the Vapers Philippines put it, ““If we had waited for clinical studies and scientific certainty, we wouldn’t have seat belts, motorcycle helmets, cleaner fuel, or healthier foods.”

While the attitude in the United States towards e-cigarettes is largely negative, some progress is being made by politicians who object to heavy taxes and ban on e-cigarettes. The United Kingdom could be called the current world leader in e-cigarette approval, as it has declared e-cigarettes 95 percent safer than smoking and encourages smokers to switch. But other parts of the world have a very negative view of e-cigarettes, especially in places where smoking is a bigger problem than it is in the west. Asian countries are home to most of the world’s smokers, about two-thirds, but some Asian countries have banned e-cigarettes completely.

With WHO acknowledging on the one hand that e-cigarettes are safer than smoking, but on the other hand considering banning them anyway, there are suspicions of ulterior motives. Cigarette tax money is on the decline in areas where smoking rates are dropping, so governments and health organizations that support them might secretly prefer that a portion of the population, at least, keep right on smoking. In the U.S., out-and-out bans on e-cigarettes are not as popular as taxing e-cigarettes as if they are the same as tobacco cigarettes – which the Food and Drug Administration says that they are.

There is no word yet on what WHO decided on the subject of e-cigarettes, so we will have to wait and see, and be prepared to fight back if they fail to do the right thing.

Thomas Frieden is worried about e-cigarettes. The director of the United States Centers for Disease Control and Prevention believes that because e-liquid comes in flavors, children and teens will be led to smoking real cigarettes once they get a taste of a strawberry or watermelon flavored e-cig. Mr. Frieden is apparently a logical man, because he knows that “the plural of anecdote is not data,” which is why he doesn’t believe in the surveys that show that millions of American smokers have successfully quit smoking with the help of e-cigarettes.

But Mr. Frieden is able to believe a survey that showed that teens who try e-cigs are less inclined to say they’ll never smoke than other teens, and he sees this as proof that kids right now are smoking because they got hooked on tobacco through e-cigarettes.

It’s this kind of logic that causes many in government to continue to insist that e-cigarettes are harmful, especially to the youth of America. The reality is that in the teen survey, a whopping 97 percent of teens who had tried an e-cig said they would not consider smoking cigarettes. Of the 3 percent that said they would, it is plausible that they were inclined to want to smoke to begin with, and tried an e-cig because of that, and not because they were drawn in by the promise of tasty candy flavors.

Furthermore, in the years since e-cigarettes and vaping have been on the rise, teen smoking rates have declined, not risen. Despite all the evidence, both survey data and sound scientific research that fails to show any relationship between e-cigarettes and bad health, most anti-smoking groups are firm in their anti-e-cigarette stance and have managed to convince many U.S. lawmakers to see their point of view.

The problem with the anti-vaping craze is that making e-cigarettes less attractive by banning flavors or taxing e-cigarettes heavily could have the very effect that anti-smokers want to avoid: driving people to choose regular cigarettes instead.

The flavor frenzy is a big part of anti-vaping rhetoric. The vaping industry has been accused of targeting children and teens specifically because it offers flavored e-liquid. But a reality check shows us two things:

• Flavored tobacco cigarettes are illegal in the U.S., so it makes no sense to think that someone who uses e-cigs for the flavors would switch to tobacco cigarettes which are only available in plain or menthol.

• Adults like flavors too. In fact, about 75 percent of e-cig users who quit smoking said they prefer flavors to the taste of tobacco, and many said that flavor variety in e-cigarettes is important to them.

Eliminating flavored e-liquid would render e-cigarettes all the more similar to tobacco cigarettes, and give smokers one less reason to make the healthier choice of vaping.

Smokers looking for less harmful alternatives or new quitting methods have been all but nailed into their coffins. Dramatic, yes, but seriously true. Anti-vaping groups have pushed a message onto the general population without realizing the full consequences of their actions. These groups are known for demonizing vapor products to discourage non-smokers, but what they don’t realize is they’re effectively dismantling an entire industry that could have helped smokers trying to quit. This is obviously not in favor of big tobacco, though, and because those huge manufacturers have money to throw around, they are going to take control of all things vaping.

Considering the number of traditional cigarette-related deaths, one would think the U.S. government would be concerned in lowering these numbers. However, the FDA is literally stopping vapor businesses in their tracks. After 10 years, one of the biggest companies in the industry, NJoy, has filed for bankruptcy. More than likely, this is due to the over-regulatory restrictions that recently passed on August 8, 2016. These restrictions require very specific lab testing to be done which obviously comes with a big price tag. Not even the largest vapor companies are going to be able to stay afloat with so many application fees for each flavor or device manufactured.

For those of us that have been unsuccessful at past quitting efforts, vaping is the safest alternative on the market today. When a city, county, or state categorizes e-cigarettes with “analog” tobacco products, they are conveying a message to the general public: “e-cigarettes must be the same as regular cigarettes, so they must not be safe.” On the other side of the coin, there are studies from numerous organizations showing this is not the case. E-cigarettes are a healthier alternative to smoking, but the industry doesn’t want non-smokers to buy their product – only those already doing damage to their bodies with tar and the thousands of chemicals that are pumped into cigarettes.

Let’s set the record straight, folks: the contents of an e-cigarette are not as dangerous to inhale as those of a traditional cigarette. Also, there are no significant second-hand effects with vaping as compared to smoking. Numerous studies have provided this information and will continue to do so. It’s quite possible that the negative connotation developed by anti-vaping groups is going to cost us lives in the end – lives of those looking for a way out of the grips of tobacco. Now, this group is going to miss out on what could have been the greatest opportunity to change their lives and move toward a healthier lifestyle.

It looks like e-cigarettes can add keeping weight gain to a minimum to its list of health benefits.

Reuters is reporting that a new paper from a team of researchers, which was published earlier this week, shows that there may be a correlation between weight maintenance and smokers using e-cigarettes. The paper looked at a range of studies that examined nicotine’s influence on the body. The conclusion the authors arrived to was that the relationship between nicotine and e-cigarettes is viable and should be the subject for further study.

This might come as a surprise to traditional smokers, but what keeps people slim when they smoke is not the tobacco, but the nicotine found naturally in the plant. Nicotine is known to be an appetite suppressant as well as a booster for the metabolic rate, which is why smokers tend to weigh less, on average, than someone who doesn’t smoke and has the same lifestyle.

One of the main reasons traditional smokers put off quitting is the fear of gaining weight. As the Guardian points out, the recent drop in smoking has led to an uptick in rates of obesity, leading some scientists to argue that e-cigarettes are a good way to curb that weight gain.

So the question then becomes, what makes e-cigarettes better for weight maintenance than other nicotine replacement therapies?

One theory, which was put forward by co-author Linda Bauld, is that e-cigarettes come in a wide range of flavors and nicotine strengths. The sheer amount of e-liquids that currently exist on the market help soothe hunger cravings, reducing the urge to smoke. And because e-cigarettes are customizable in terms of the nicotine strength, traditional smokers can decrease their nicotine consumption gradually without fearing weight gain.

Amanda Sandford, a spokeswoman for Action on Smoking and Health, put it best when she said that: “The risk of putting on weight when quitting smoking is a common concern and can discourage smokers from trying to stop. E-cigarettes are a safer alternative to tobacco and if they can also help people avoid piling on the pounds as well as helping them to stop smoking that is a real bonus.”

While the jury is still out on whether or not e-cigarettes can definitely prevent weight gain, it’s looking more like it is probable that it can help traditional smokers kick the habit while maintaining their weight. And if more studies come out to this effect, the government will have a much harder time trying to convince e-cigarette users that the products are bad for their health.

The Vertx Plus is packed with more power than other micro-cig battery. Facebook’s policy has always been to include vapor devices under the category of tobacco products, but now the vaping community is asking for Mark Zuckerburg to reconsider. Kevin Price has started a petition on Change.org, asking for vaping goods to be listed separately from tobacco. So far, the petition has already gained more than 12,000 signatures.

In the past, Facebook has argued that vapor devices should be classified as tobacco products because of nicotine content, but those signing the petition have argued that some eliquids are nicotine free. Furthermore, nicotine is also contained in products like eggplant, cauliflower, or tomatoes but those aren’t categorized as tobacco products.

Additionally, the group argues that vaping actually helps people quit smoking, and that Facebook’s stand overlooks this important reality. Many vapers are sharing their stories in hopes that Facebook will have a change of heart.

Zuckerburg, however, continues to ignore these pleas. But this is not the first time that Facebook has been in disagreement with third parties over its policy on vaping products. Last year, the social media giant attempted to censor ads for “A Billion Lives”, a documentary film that will advocate for the use of vaping for smoking cessation. A similar petition was ultimately what caused Facebook to allow “A Billion Lives” to air their advertisements.

With any luck, the current petition will cause Facebook to rethink its general policy and acknowledge the massive difference that exists between traditional tobacco products and vaping devices.

New York City has already included ecigs in their ban on smoking in public places, but the rest of the state is still trying to catch up. So when an ecig user was issued a citation for using his ecig on a subway platform, he took the matter to court. After hearing both sides of the story, the judge ruled that using an ecig was not actually smoking and banning tobacco use does not mean ecigs are automatically outlawed.

In the case of “People vs. Thomas”, the Judge pointed out that the New York state law has a clear definition of smoking and it doesn’t include any language about ecigarettes. The state defines smoking specifically as “the burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco”.

“An electronic cigarette neither burns nor contains tobacco,” the court noted. “Instead, the use of such a device, which is commonly referred to as ‘vaping,’ involves the inhalation of vaporized e-cigarette liquid consisting of water, nicotine, a base of propylene glycol or vegetable glycerin and occasionally, flavoring.”

The state tried to argue that ecigs should be automatically lumped in with tobacco products in public smoking bans because “the courts of New York have yet to make a determination as to whether electronic cigarettes are to be viewed any differently under these sections than tobacco cigarettes.”

But the judge wasn’t buying it. He pointed out that the state’s literal definition of “smoking” left no room for argument because it quite clearly excludes ecigarettes since they do not in fact contain tobacco or involve any burning.

Candidates continue to fight for the top spot in this year’s presidential election. As poll numbers bounce up and down, special interest groups are gaining a lot of attention, but one group might matter more than others according to a recent article in the Huffington Post. Electronic cigarette users could have the final say to determine the next POTUS.

According to HuffPost, many political pundits are closely watching the ecig industry to see which candidates garner the most support. Grover Norquist, the libertarian founder of Americans for Tax Reform, believes ecig fans will play a huge part in this year’s election. “I think that the next election, at the presidential level, and a lot of other levels, is going to be determined by the vaping community,” he said.

Norquist pointed out that ecig users are highly educated and spend a great deal of time advocating for fair and balanced regulation. “Vaping is not a product. It’s a movement,” he said. “It is a community, it is a political movement in support of a community and it’s changing the country in very good ways.”

There are currently around 10 million ecig users in the United States, a significant number when you consider the potential weight on an election. Ecig users are a passionate group, with a history of tobacco addiction and a firsthand knowledge of how ecigarettes offer a better alternative that can be life changing. If an candidate threatens their lifestyle and ultimately their ability to stay tobacco-free, it’s bound to swing the vote.

As far as party lines go, Norquist believes most ecigarette users and advocates will lean towards the GOP. “Democrats are hostile to the vaping revolution and will use taxes and regulation to throttle a growing industry that could potentially save lives,” he said.

Norquist and his colleague Paul Blaire spoke out about this issue in a recent issue of National Review. “Since 1998, governments have collected more than $500 billion in cigarette taxes and payments from smokers. In 2013, Master Settlement Agreement (MSA) payments and taxes helped the government rake in nearly $44 billion. No such punitive tax regime exists for e-cigarettes. Each time a smoker picks up an e-cigarette in Michigan, the state loses $2, and the federal government loses $1.01 per pack; in Illinois, $1.98, and in New York, $4.35. It adds up quickly, and for big spenders in state capitols, that’s a problem.”

When it comes to medical research, there is no other hospital in the United States more respected than Mayo Clinic. When the doctors at Mayo release new information, the world listens because they know this hospital is trustworthy and on the cutting edge of medical research. Recently, the Mayo Clinic released results from their latest experiment in smoking cessation. After noting that smokers face far higher risks of complications following surgery, researchers decided to offer patients “electronic nicotine delivery devices” both before and after their surgeries. The goal was to see if the ecigs could help patients successfully reduce tobacco consumption or eliminate cigarette use altogether.

Smokers who were facing upcoming elective surgeries were provided with the “electronic nicotine delivery” devices and encouraged to use them anytime they got a craving for a cigarette. Researchers kept records of their tobacco consumption and behavioral changes while using the ecigs and followed up 30-days later to see if there had been any significant change.

At the time of follow up, the Mayo Clinic team found that 17 percent had already completely quit smoking. Another 51 percent said they intended to continue using the devices in the future. Most remarkably, cigarette consumption was drastically reduced after patients had access to ecigarettes. “Average cigarette consumption decreased from 15.6 per person to 7.6 over the study period,” the study concluded. Ultimately, researchers said that ecig “use is feasible and well-accepted in surgical patients.”

This is the first time we’ve seen a prestigious hospital praise ecigarettes for their potential to help smokers. Now that Mayo Clinic took the leap, it’s safe to say that other doctors might feel more confident to recommend ecigarettes to their patients, especially those facing surgery. The medical community is well aware that other nicotine replacement therapies just aren’t that effective, but all signs show that ecigs can work and actually make a remarkable difference in a relatively short period of time.

According to a study that recently appeared in Tobacco Control, ecigarettes are putting teenagers at serious risk. Researchers from the University of Hawaii Cancer Center alleged that ecigarettes actually lead teenagers to start using tobacco. As the world reacted in alarm to this shocking news, Forbes contributor Jacob Sullum actually looked at the data and realized that the scientists got it all wrong. Rather than making teens smoke more, the data shows that ecigs could be responsible for a serious decline in teen tobacco use.

“Smoking among American teenagers has continued to decline, reaching the lowest rate on record last year, as more and more of them experiment with vaping,” Sullum wrote. “These opposite trends seem inconsistent with warnings that the rising popularity of e-cigarettes will encourage consumption of the real thing.”

Critics might argue that teen smoking rates would be falling even more if ecigarettes weren’t luring them back in. But Sullum said the study’s data gives no evidence to support that theory. The research in question was centered on a survey of 2,300 high school students who were questioned about their tobacco use. The study found that students who had never smoked in 2013 were three times more likely to be using tobacco a year later if they tried an ecigarette during that time.

Sullum argued that the researchers are playing a game of semantics, twisting the data to reach a conclusion that just isn’t supported by the facts. “Although the researchers talk about the ‘onset of smoking,’ the measure they used was whether subjects had tried conventional cigarettes at all,” Sullum explained. “It’s not clear how many of those (who tried a cigarette) will ever be regular cigarette smokers.”

While the study paints a cause-and-effect link between ecigs and tobacco use, it just wasn’t there in the data. Instead, we see that some teens are more likely than others to experiment. Those who experiment with ecigs are also likely to experiment with cigarettes and vice versa.

The Hawaiian study claimed that teens jump from ecigs to tobacco because it’s a similar experience and they can get a bigger hit of nicotine if they use the traditional cigarettes. In essence, the study concluded that ecigs were a gateway that led teens to tobacco use. “E-cigarettes mimic the look and feel of cigarettes, and the inhaling and exhaling of e-cigarette aerosol produces some of the same sensory experiences as smoking a cigarette,” the researchers explained. “This similar experience may contribute to an inclination towards trying cigarette smoking.”

But Sullum argued that there is no real evidence to support this theory. “Even if it were true that teenagers who smoke tend to vape first, that would not prove vaping causes smoking.” The logic used in this study is similar to what we’ve seen from marijuana critics who claim that smoking pot is a gateway to heroin use. Realistically, thousands of people use cannabis and never go anywhere near heroin. But many heroin users have tried marijuana at some point in the past. That doesn’t mean that smoking pot leads to heroin addiction. It just means that some people are more likely to experiment with both drugs and pot was probably first because it’s cheaper and easily accessible.

The same gateway argument is at play here with ecigarettes. Just because a teenager tries an ecig once and then later starts smoking, it doesn’t mean that the ecig is responsible for the future tobacco use. In reality, the teen would have probably ended up smoking regardless of access to ecigarettes.

Instead of viewing ecigs as a gateway to tobacco use, most studies show that they have the opposite effect by causing teen smoking rates to decline. According to a Monitoring the Future Study, teen tobacco use dramatically declined after ecigarettes hit the US market. Coincidence? Probably not.

The bottom line is that teens shouldn’t be smoking or using ecigs and we need laws to prohibit sales to minors. However, some ecig critics are pushing for hard nosed bans on ecig flavors that adults enjoy by using the argument that we need to protect our teens. In the Forbes article, Sullum insists that this would be a terrible mistake.

“Rules that make vaping less attractive to current smokers could undermine public health by impeding the replacement of cigarettes by a much less harmful alternative. Worrying about vapers who become smokers while overlooking smokers who become vapers is a recipe for deadly public policy.”

Over the past few years, we’ve seen that the nation’s richest citizens have a lot of control over the course of our laws. Lobbyist funds heavily influence the votes of our politicians and now we even have billionaire Donald Trump in the running for the presidential election. Ultimately, money talks and if you have enough of it, you can make almost anything happen. Unfortunately, some people use the power of money to accomplish terrible things, even if they have the best of intentions.

That’s exactly what’s happening right now in California. Tom Steyer, a hedge fund manager turned billionaire, has pledged to give a million dollars towards his pet initiative that would place a new tax on ecigarettes and increase the current tobacco tax by $2 per pack. If Steyer’s money can buy enough votes, it would mean a 70 percent excise fee on all of California’s ecigarettes, cartridges, and vapor products.

“You can’t sugar-coat it, smoking is deadly,” he told the LA Times. “This initiative aims to save lives and stop teens from ever picking up the deadly tobacco habit in the first place.”

While Steyer might sound like his heart is in the right place, a closer look shows that money is definitely at play here. If his tax initiative is accepted, California will rake in a hefty $1.5 billion every year, much of which will end up tied up in the state capital. How many of the state’s leading politicians are in bed with the Steyer financially, so to speak?

Historically, California has had one of the lowest tobacco taxes in the country, at only 87 cents per pack. This tax rate has remained the same since 1998 with repeated failed attempts to increase it. Despite the low taxation, California has fewer smokers than the rest of America with only 11.7 percent of adults smoking compared to 18 percent nationwide.

Now voters will have the ultimate say in the issue by choosing their politicians in this year’s state elections. Americans for Tax Reform has already stepped in, urging voters to choose carefully. While hefty ecig taxes have already been rolled out in ten other states, they have been counterproductive. Instead of decreasing smoking rates, the tax on ecigs seems to deter smokers from switching, thereby increasing the number of smokers and keeping more people chained to tobacco products.

No one wants to see kids using e-cigarettes, but in most places, they are easily accessible. When a teen walks into a vape shop, far too often they can buy anything they want with no questions asked. With no current regulations to insure the devices offered are safe and built to certain quality standards, tragedy can strike in an instant. This is especially true in situations where teens seek out mechanical mods that can create big vapor clouds, but often carry heavier risks for malfunction.

That’s exactly what happened this week when a 16-year-old teen from Canada suffered serious injuries after an ecigarette exploded in his face. Perry Greer said his son, Ty, was using the ecig in his car when suddenly it just blew up. “It lit my kid’s face on fire, busted two teeth out,” Greer said. “It burned the back of his throat, burned his tongue very badly. If he wasn’t wearing glasses, he possibly could have lost his eyes.” Greer rushed his son to the hospital, but he said the teen was in such agony that he actually begged to die. “He wanted to die. That is how much pain he was in.”

The teen was using a Wotofo Phantom, a Chinese ecig that is commonly sold in vape shops across Canada. “He pushed the button and blew in, and then you wait a couple of seconds, and then you puff on it. It was about two inches from his mouth and it just blew apart.”

Now Ty is being treated for first and second degree burns. He had multiple lacerations to his face and has already undergone two root canals. His face was blackened with burns following the explosion. “It is horrific to see your kid with his face so burnt,” Greer said.

After watching his son suffer such horrible injuries that will undoubtedly lead to life long scars, Greer is calling for officials to take action and ban the sale of ecigs to all minors. Currently, Alberta has no provincial rule regarding ecigs and allows municipalities to create guidelines as they see fit.

Les Hagen from Action on Smoking and Health expressed his sympathy for Ty and his serious injuries. He pointed out that this is just another example of the need for regulatory changes to protect our kids from sub-standard ecigarettes. “We absolutely need product standards. For instance, they shouldn’t explode in your mouth,” Hagen said. “The other element with this particular incident is this product was sold to a minor, to a 16-year-old. We would like to see a ban on the sale of these products to minors, just like we have with cigarettes.”

It’s time for officials to take action and make new laws to prohibit teens from buying ecigarettes. While ecigs can often provide smokers a smart alternative to tobacco, they can also be dangerous when used incorrectly. If we want to protect our young people, we need to insure that the local vape shops cannot legally sell them ecigs anymore. Do you think ecig sales to minors should be completely banned?

Over the past few years, we’ve seen more than our fair share of bad science in the ecig industry. But a recent ad campaign from Alaska is without a doubt the most damaging we’ve seen to date. In a new commercial, Alaska’s health authorities allege that ecigs are actually more harmful than cigarettes. But it gets even worse. The commercial implies that ecigs can cause brain damage or cause smokers to develop asthma. It even suggests that your ecig could contain embalming fluid and nail polish remover.

When addressing the fallacies promoted by this commercial, it’s hard to know where to even begin. First and foremost, ecigs have been repeatedly proven to be a safer alternative to cigarettes. They contain no tobacco and no tar. We also know that ecigs won’t give you asthma. In fact, it’s quite the opposite. Research shows that asthma sufferers who switch from cigarettes to ecigs show dramatic improvements in their symptoms. And of course, there is absolutely zero evidence to support the theory that ecigs contain embalming fluid or nail polish remover. Health authorities were obviously going for shock value at the expense of actual science.

This ad isn’t the first example of Alaska’s erroneous views on ecigarettes. The Chief Medical Examiner has repeatedly claimed that ecigs are a greater threat to teens than cigarettes. He told KTTV News that vapor devices are a major concern. “We do see more kids using e-cigarettes now than smoking, so e-cigarettes right now are the neatest, shiniest thing and they’re kind of cool so in that sense they do provide a riskier alternative to cigarettes.”

Valerie Davidson, the Commissioner of Alaska’s Department of Health and Social Services, has also condemned ecigarettes. “If we know that kids think e-cigarettes are not smoking and e-cigarettes are ok and they’re a better alternative to smoking, we need to let them know that they are just as harmful, and perhaps more harmful, than smoking cigarettes and chewing tobacco.”

Davidson also claimed that ecigarettes contain tobacco, which is absolutely untrue. “We all have known for a long time the dangers of tobacco use and the dangers of nicotine use, but for some kids they don’t think of e-cigarettes as necessarily being cigarettes or being tobacco, but they are.”

Ultimately, Alaska’s blatant display of ignorance regarding electronic cigarettes is not only dangerous; it’s irresponsible. By purposefully arming youth with wrong information, they are insuring another generation of smokers will die from cancer, heart disease, and other tobacco related diseases. Should these health authorities be held accountable for the damage that will soon ensue in Alaska?

Ecig regulation is a controversial topic these days as the world awaits finalization of the FDA’s regulatory proposal. While no one can be 100 percent certain of what the future holds for ecig companies, we do know that the current proposal would be murderous for the industry as a whole. At this point, we know that the FDA plans to require a Pre-Market Tobacco Application for every ecig that was released after February 15, 2007. Each application could cost as much as 10 million dollars and for the vast majority of ecig companies, it would be the death nail that leads to a permanent shut down.

The FDA knows that their proposed rules would essentially create a de facto ban on vaping. In fact, their own economic impact analysis revealed that 98.5 percent of ecig companies would be unable to complete the application process, thereby making it illegal to continue selling ecigs and eliquids. If the rules will eliminate almost all of today’s ecig businesses, it’s clear that the FDA is moving in the direction of prohibition.

Yet one FDA advisor isn’t ready to admit to an ulterior motive just yet. Dr. Thomas Eissenberg, a member of the advisory committee on tobacco products, claimed this week that he has seen zero evidence to indicate that the new rules will lead to prohibition. However, ecig industry leaders aren’t convinced. Dr. Michael Siegel said the FDA “is essentially making a decision to prohibit these products, or at the very least, to prohibit 99 percent of these products.” Ironically, the FDA’s underhanded approach to regulating ecigs is much harsher than the approach taken with tobacco cigarettes.

Are you concerned that the vast majority of ecigs and eliquids will disappear from the marketplace as a result of the FDA’s involvement? Do you think they are strategically choosing rules that will force ecig vendors out of business?

While no one wants to see teenagers using ecigarettes, most of us would agree that it’s at least a better scenario than if they were using tobacco products. Unfortunately, some of the world’s leading health organizations disagree. The American Heart Association released a statement about teens and ecigarettes this week and it has left many people feeling frustrated and confused. The AHA is apparently not too happy that kids are opting to use ecigs instead of smoking traditional cigarettes. “While the downward trend in teen cigarette smoking is a wonderful victory, this success has been sullied by the disturbing trend of young Americans turning to e-cigarettes and cigarillos, and away from traditional cigarettes.”

Considering that the AHA has spent millions of dollars and untold hours trying to convince kids to stop smoking, their stance is completely counterintuitive. Why would they find it disturbing that kids are shunning tobacco products even if they are opting to use ecigs? Isn’t this at least a step in the right direction? It seems like these public health leaders would be happier if our kids were still smoking cigarettes and it just doesn’t make sense.

This statement really gives us a peak into the continued and oftentimes purposeful ignorance about ecigarettes that is common in the field of public health. Despite repeated evidence that ecigs help people quit or drastically reduce their tobacco intake, many health agencies like the AHA still frown on ecigarettes as a dangerous enemy.

To complicate the situation even further, the AHA didn’t take issue with teens using ecigs because they were unhealthy or even because they were addictive. They aren’t making either of these claims. Instead, they are disturbed that teens are using ecigs in general – just because it has the appearance of tobacco use and is enjoyable. The AHA even believes nicotine-free ecigs are a threat to teens and that is the most confusing part of their remarks. After all, if they are only inhaling a harmless vapor mist with no chemical additives and no nicotine, why is it a big deal? Why is this not better than smoking cigarettes?

It seems that the American Heart Association has decided to do away with common sense and further the war on ecigs without any due cause. Do you think the AHA’s response to teens using ecigs is appropriate? Should parents be concerned if their child switches from cigarettes to ecigs?

One of the biggest complaints among former smokers is weight gain. It seems like as soon as you kick the cigarette habit, you see a sudden change in your waistline. It’s a lose-lose situation for many smokers. By getting rid of cigarettes to improve their health, they actually end up acquiring new health risks associated with obesity. It’s trading lung cancer for diabetes and heart disease. Neither situation is ideal.

Scientists believe that weight gain associated with smoking cessation is all rooted in nicotine’s ability to suppress the appetite. Once you stop using nicotine, your appetite suddenly spikes. To make matters worse, many smokers turn to food to fill the void and cope with stress and anxiety when they give up cigarettes. Research shows that 80 percent of former smokers gained weight when they kicked the habit.

So how can you stop smoking without packing on the pounds? A new study suggests that ecigarettes might be the answer. Researchers examined changes in body weight when smokers traded out their cigarettes for ecigs. They found that there was no significant weight gain at all. In fact, even the smokers who chose to use ecigs with zero nicotine still managed to stop smoking without gaining weight. Plus many reported that giving up tobacco was easy with the help of an e-cigarette.

This particular study focused on female smokers so more research is needed before we can officially declare that ecigs prevent weight gain during smoking cessation. However, the results were very promising since women tend to gain weight more often than men while kicking the cigarette habit. In the future, scientists hope to do a broader study with men and women to learn more about the connection between ecigs and weight gain prevention.

The best way to stop America’s smoking problem is to tax it into oblivion, right? That’s what many of our politicians have claimed in an underhanded effort to boost tax revenue. But now new reports are revealing that increased taxes might not be the answer after all.

New York’s scheme to increase tax revenue by passing an increased smoking tax backfired, costing the state millions. New Yorkers now pay a whopping $10.60/pack on legal cigarettes in the state, due to the astonishingly high tax rates imposed in the years since 2006.

For the smoking New Yorkers, the final straw came in 2010 when New York increased the state smoking yet taxes yet again, this time almost doubling the state’s tax on the luxury item. New York’s tax skyrocketed from approximately $2.75 sales tax per pack in 2009 to an outrageous $4.35 per pack in 2010.

Sales of cigarettes immediately plunged in New York. However, instead of raising the millions the state intended when it increased the cigarette taxes 190% in the last decade, New York has lost an estimated $400 million dollars in tax revenue.

The loss of revenue is not because the good citizens of New York have kicked the habit, they have just given up purchasing their cigarettes legally. The New York Post reported that the state lost out on an approximate $1.3 Billion dollars in uncollected sales taxes as a result of smokers switching product lines for cheaper alternatives.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives are taking a hit resulting from this tax scheme as well. It is estimated that the ATF loses roughly $5.5 million dollars annually to New York cigarette smugglers.

New Yorkers have established a veritable black market of cigarette sales. Residents are heading out of state to purchase cigarettes with reduced tax, In fact, The Tax Foundation estimates that roughly 58 percent of the cigarettes smoked in the state of New York originate across state lines and the packs of properly taxed product has dropped by nearly 62 percent.

The steep rise in cigarette smuggling rings in New York has also spurred a statewide increase in the presence and influence of organized crime in New York as smugglers rush to meet the increased demand of illegally acquired smokes.

Additionally, many critics maintain that the cigarette tax does more than just increase crime. They claim that the exorbitant tax causes a disproportionate strain on lower income residents who now spend an estimated 23.6 percent of their annual income on cigarette smoking. It is likely that this further depletes the state of funding by draining resources that are redistributed to meet the needs of the poor.

The New York cigarette tax scheme has been a complete failure. Not only has it failed to raise revenue for the state, it has actually plummeted the taxes they already were collecting. The tax has not decreased the number of smokers in New York either or reduced the cost to public health; it has simply exported what revenue it could have gained to other states.

Rather than taxing cigarettes at such astronomical rates, wouldn’t it be smarter for states to offer smokers a reasonable tobacco-free alternative? Electronic cigarettes would be an easily available option that could legitimately help smokers kick the habit. Of course, legislators aren’t really all that interested in public health. Instead, they are looking at the bottom line. So in the big scheme of things, it looks like high cigarette prices are here to stay. Now the only question is how high the tax on ecigs will go in the future.

After years of fighting with a serious smoking addiction, the UK’s Prime Minister is no stranger to the struggle to kick the habit. Perhaps that’s why he has exercised an added measure of compassion towards tobacco users and gone to great lengths to help them successfully quit. Each year, 80,000 people die from smoking related causes in the UK, but the tide is slowly turning. So far, 2.6 million smokers have already switched to ecigs, choosing a tobacco-free alternative as a bridge towards a smoke-free lifestyle.

Prime Minister David Cameron recognizes that ecigarettes are saving lives and this week, he spoke out about the controversial issue. He called ecigs a “legitimate aid” for smokers who are trying to quit.

“Certainly as somebody who has been through the battle a number of times, eventually relatively successfully, lots of people find different ways of doing it and certainly for some people e-cigarettes are successful,” the Prime Minister said.

“I think we do need to be guided by the experts. We should look at the report from Public Health England but it is promising to see that over all, one million people are estimated to have used e-cigarettes to help them quit or have replaced smoking with e-cigarettes completely.”

Public Health England has been very vocal in their support of ecigs. In fact, earlier this year, the agency released a study that found ecigs were 95 percent safer than tobacco cigarettes. They followed up the new study with a recommendation that NHS provide ecigs at no charge to smokers who were trying to kick the habit.

Cameron has been very supported of PHE’s approach to ecigarettes. “I think we should be making clear that this is a very legitimate path for many people to improve their health and the health of the nation,” he said.

Over the past few years, e-cigarette shops have multiplied at a rapid pace. It wasn’t all that long ago when ecigs were still a rare commodity that people didn’t understand. Now, you can find a place to buy ecigs and eliquid in all of America’s biggest cities and many small towns. Now a new study is providing a closer look at what these stores offer and how they are handling the current regulatory uncertainty.

The 2015 Vape Shop Index was a joint effort from several major ecig advocacy organizations and research specialists: Ecig Intelligence, E-Cigarette Forum, SFATA, and Roebling Research. After collecting data from 540 ecig shops across 42 states, the results clearly showed a growing level of success among even the smallest ecig retailers.

On average, these shops are raking in $26,000 in sales every month. Owners report that their best sellers are low-nicotine eliquids in the 3 to 6 mg/ml range. Most stores offered ecigs and advanced vapor devices too, but eliquid still managed to account for at least 50 percent of sales.

“This really is the first time that the industry will have detailed independent data from vape shops, where much of the growth in the sector is now occurring, reaching more than $1.5 billion in annual revenue,” said Tim Phillips, CEO of ECigIntelligence. “As consumer preferences evolved toward open system tanks and e-liquids, we saw a need for accurate data to help shop owners better compete in today’s marketplace.”

Steve Hong, principal at Roebling Research, said the data is significant because it reveals just how successful a small town ecig shop can be in today’s culture. Hong believes the future will only bring greater profits are stores gain more experience and expand to future locations. “As the vape shop channel continues to mature, we’ll probably see more consolidation as established vape shop retailers continue to grow and expand their businesses,” he said. “There’s no doubt this channel is driving the broader category and we expect the channel to grow even bigger next year.”

Of course, owning an ecig shop doesn’t come without its risks. Store owners face a lot of unknown factors in planning for 2016 with regulations looming. While 98 percent said they would support “reasonable” regulations, 67 percent felt the current FDA proposal and state-level ecig policies were harmful.

Cynthia Cabrera, President of SFATA, said the FDA could essentially crush these business owners in one swift move with the current regulatory proposal. “Anything onerous, such as the FDA’s pending final rule, could seriously impact tens of thousands of jobs.”

Despite the ongoing debate about how to best regulate ecigarettes, most brick-and-mortal ecig retailers have a positive outlook. In fact, 76 percent said they expected to see their businesses grow in the coming year and they expressed optimism for the future potential of the ecig industry.

Officials in the state of Utah are pushing for new ecig regulations that could have disastrous consequences. Ecig advocates believe that the proposed rule is so strict that it would result in as many as 80 percent of the e-liquids being banned for sale in the state. With such fierce opposition to this rule, the Health Department could be forced to reconsider its approach.

The proposed guidelines would require that all eliquids have child-proof packaging and warning labels that state, “Nicotine is addictive and poisonous. Keep away from children and pets.”

Tad Jansen has extensive experience in the ecig industry as owner of a Utah vape shop and president of the Utah Smoke Free Association. He sells various e-liquids in his shop that would be impacted by the proposed new rule. He said that if this rule goes into effect, up to 80 percent of the e-liquids that he sells would potentially be banned. This is because the e-liquids are mostly produced overseas and out of state. He contacted several of these manufacturers about the new labeling requirements to gauge their willingness to comply. But the vast majority said that they would not create the required warning labels just to satisfy Utah’s officials because of the significant increase in production costs.

Jansen and other vape shop owners have appealed to the Administrative Rules Review Committee to reconsider their approach on the ecig labeling. Even lawmakers are starting to speak out about the proposed changes, cautioning health regulators to slow down and rethink the rules. According to Democratic Senator Gene Davis, “This rule is not ready for prime time.”

Robert Rolfs, the Health Department Deputy Director, argued that eliquid manufacturers will have sufficient time to adjust their labeling procedures since the rules won’t be enforced until July 2016. He feels this gives them ample time to make adjustments or for the legislators to make changes to the proposed rule. He also said that this proposal has more support than dissent.

For now, Utah ecig fans are encouraged to contact their local lawmakers and ask for the rule to be revoked. Otherwise, 80 percent of the top selling eliquids could disappear from the shelves permanently.

Retailers in Montana who plan to sell ecigarettes after the New Year will have to obtain a state license to do so legally. As of January 1, 2016, retailers must be officially licensed and all ecig sales to minors will be banned. Department of Revenue officials said that 1,800 postcards are out in the mail to retailers throughout the state reminding them to obtain an Alternative Nicotine or Vapor Products license this month. Ecig vendors can apply for the license online and renew it annually for only $5.00. There are an unlimited amount of licenses available so every retailer can easily obtain one.

Tim Fox, the Republican Attorney General, along with Diane Sands, a Democratic Senator who acted as a sponsor, put forth Montana Senate Bill 66. A portion of this bill holds this new license requirement. Those who continue to sell ecigs without the proper license will face a $100.00 fine.

“We want to keep things within a manageable arena for public health and safety reason. It’s the same reason that we license tobacco, and that we give you a driver’s license,” remarked Mary Ann Dunwell, a Department of Revenue spokeswoman.

Surprisingly, most of the state’s vape shop owners seem eager to comply with the new requirement. In fact, the bill was partially written by Ron Marshall, owner of Freedom Vapes. He said the licensing requirement is actually a positive step for ecigarettes because it distinguishes them as different from tobacco products.

“It was written so that we could prohibit sales to minors without labeling vapor products as tobacco products,” he explained. “That’s why there is a separate license for tobacco retailers and vape retailers.”

This new requirement is a big deal when you consider that Montana is the only state to legally classify ecigarettes as non-tobacco products. By keeping the two separate, it will only help vapers in the long run by protecting their rights to use ecigarettes in areas where tobacco products have been banned.
